You say you drove the car home from the mechanic? If it moved under it’s own power he has done his job, but you may still have a remedy. Read the service warranty; look for language stating something about the “number of miles driven limit” under warranty or something like that. If it sat a long time, it may have leaked fluid or needs more. Does it refuse to move the car at all or does it not shift properly when in motion? Your question is not specific.
Lastly, there are no guarantees in court. Anybody may lose a case they think is a slam-dunk for them. You do not need a lawyer in small claims court.
If the trans is “just short” of its warranty, that says to me that there is still warranty remaining. If it were “just over” its warranty, that would be different.

Need a lot more information. How many miles had been driven in between, what was fixed, what is needed now… There is a lot to this equation. If it is the same repair and his warranty is only 90 days and you are out. Then sadly you are out. But he won’t be in business long with that type of mentality.
This is why I recommend the dealer for service. A reputable dealer would not leave you in this situation & their warranties are always atleast 12 months or 12,000 miles. ‘
